Terms and conditions for participation in the prize contest ‘’Walk to Planica 2018’’ on Instagram profile ocplanica

1. General provisions

The prize contest is organized by Ski Association of Slovenia - OC Planica (hereinafter Organizer). It takes place on an official Instagram profile ocplanica from 22 March 2018 to 25 March 2018.

2. Participation in the prize contest

The prize contest is open to individuals above the age of 15 years. Persons under 18 years can participate in the prize contest with the consent of parents or legal representatives.

Organizer's employees and their immediate family members may not take part in the prize contest.

3. Manner of participation

The prize contest is open to users of Instagram. In order to participate in the prize contest, the user must take a photo of him/her next to the information board, which must be visible in the photo. The board is located on the footpath between Kranjska Gora and Planica. The user must post a photo on his/her profile, and tag @ocplanica in a comment and add #planica2018 and #pesvplanico.

It shall be considered that a user, who has complied with the above requirements for publication, is acquainted with and agrees to these Terms and conditions of participation in the prize contest, which are published on the website: http://www.planica.si/en/prize-contests

All users also agree to the publication of the winning photos on the Planica official social networks.

On Wednesday, 28 March 2018, we shall choose 5 winners from all properly tagged posts, of whom each will receive one prize.

4. Prize pool

The prize pool contains five Planica 7 T-shirts.

5. Notification of the winners and prize giving ceremony

The winners will be informed about the prize in the following manners:
1. Their user names will be written in a post on Instagram profile ocplanica, on Wednesday, 28 March 2018.
2. If user profiles of the winners allow it, they will be informed about the prize through private message.
3. User names of the winners will be published on the website http://www.planica.si/en/prize-contests

Prizes cannot be exchanged for cash or any other prize.
The results of the contest are final and appeal to them is not possible.

The winner will be notified about obtaining the prize through private message. The winner will agree the manner and time of accepting the prize with the Organizer.

The winner is entitled to the prize, if after receiving a notification of prize he/she delivers in response to the Organizer's call all requested personal data and meet other organizer's requirements according to these Terms and conditions, within seven (7) working days from the notification received (for the purpose of prize distribution we need following winners' information: name and family name, delivery address).

If the winner fails to state or provide his/her personal data or these provided data is incomplete or incorrect or if a winner cannot be notified or given a prize or if established that the winner did not meet requirements to participate in the prize contest and/or he/she has violated these Terms and conditions or if a winner does not want to fulfil its obligations according to these Terms and conditions, all this within seven (7) working days after receiving the notice at the latest, the winner shall not be eligible for the prize. I case of such winner the Organizer will be exempt from all obligations and it is at the Organizer's discretion, however, to decide whether the prize will be awarded to someone else or not.

6. Income tax

A cash payment of the prize is not possible. The prize is not transferable to a third party; also it is not possible to exchange prizes.

The organizer will in the winner's name deduct advance income tax on the indicated prize value in accordance with applicable regulations. The advance tax is determined based on the prize value on the day of delivery. In case that the prize value is less than € 42.00, the advance income tax shall not be charged in accordance with the Personal Income Tax Act.

Any additional payments of income tax in accordance with the annual decision on personal income tax assessment shall be charged to the winner respectively his/her parent or legal representative.

Participants in the prize contest abstain from any kind of claims against the Organizer related to the participation in the prize contest and to prize utilization (e.g. costs of prize acceptance...).

7. Personal data protection

The Organizer of the prize contest is obliged to be vigilant to protect users' data and to use them exclusively for its own needs. The Organizer shall protect users' personal data in accordance with the Data Protection Act.

8. Liability and complaints
The Organizer of the prize contest shall not be liable for any damage suffered by the participants, in connection with prize contests. The Organizer of the prize contest shall not be liable for improper services resulting from the misuse and lack of user's knowledge and shall not assume any responsibility for temporary Instagram profile failure of ocplanica.

The Organizer shall not be liable for failure or imperfect functioning of participant's e-mail and Internet connection; also it shall not be liable for service failures caused by network failure of contractual partners, power failure or other technical interferences which could temporarily affect the use of services.

In exceptional case of early prize contest termination for reasons due to no fault of the Organizer, the Organizer reserves the right to award prizes among those who participated in the prize contest until the moment of termination or to not complete the contest, without any obligation to the participants, all in accordance with the Organizer's judgement.
In case of circumstances beyond the Organizer's control (force majeure ...), the Organizer has a right to cancel the activity. The Organizer must thereof inform the participants through the media and shall thus not be liable for any resulting damage.

9. Complaints handling and final provisions

Any disputes that cannot be settled amicably will be settled by the by a court having jurisdiction on the substance of the matter. The Organizer of the prize contest may change the Terms of participation in the prize contest. At the same, the Organizer undertakes to inform all users in an appropriate manner and at an appropriate place of any changes or amendments to the rules. These rules apply from the date of adoption onwards.  

10. Familiarity with the rules of the prize contest

By participating in the prize contest on Instagram profile ocplanica participants confirm that they are familiar with the rules of the prize contest and accept and fully agree with them.

The prize contest is not sponsored, operated or supported by Instagram nor otherwise connected to it.

By participating in the prize contest, the users of the prize contest completely exempt Instagram from any liability.
